If it is his code, he can license it as he pleases.
Those that already have copies of the code under GPL, can pass
that code with the same GPL license onto others...
He cannot retract that GPL license.

Anyway: the real legality is of course depending on the country.
But I have yet to hear of a country that's not GPL compatible.
But I am also not a lawyer :-)
