Plextor PX-EH series violates GPL?

Hi,

I sent this e-mail to the request-tracker system first, but got no  
(automated) response. So to be sure it reaches the right people, I  
send it to this list as well.

The Plextor PX-EH series are NAS devices with different hard disk  
configurations (1). The device seems to run a Linux kernel and Apache  
webserver. I believe this product violates the GPL by distributing a  
binary Linux kernel without offering the source code. I did not yet  
attempt to check the data on the harddisk of this NAS device, but a  
firmware update available at the Plextor website (2) contains this  
binary Linux kernel.
