Nop! The fact that someone violated the GPL does NOT automatically make 
the released code GPL. The copyright remains with CherryOS and you need 
it's premission to distribute it.
The violation is a matter that must be discussed between the copyright 
holders.

What you did is a *very* bad idea. (the only one who is surely violating 
  copyrights is you, be careful!)
