I think you should ask. ;-)
Just ask the author. Or just ignore him... that's probably what he deserves.

It might be that in the end it is just NOT GPL. If I say it is GPL
plus "this restriction", then it is probably not GPL anymore. In this
case it is not even "free software".

Of course I am not considering the case this guy you mention is not
the only author. In this case he might be infringing the original
author's copyright himself.
