I doubt it would have much effect, to be honest - if the company is
aware of the risks of non-compliance / copyright infringement, and is
deciding to accept those risks, even if only for a planned period, after
which is says it will distribute the code when it becomes profitable, I
would be surprised if using different terms for copyright infringement
is going to encourage it to change its (corporate) mind.

In any case, I am not familiar enough with the copyright laws of China
to know the ins and outs of this particular situation, or the likelihood
of a successful claim etc.
