It's promising that Freecom is moving to release the sources.

What Freecom needs to do is to ensure that devices distributed include a
copy of the GPL licence and either sources or a written offer to provide
the sources as per the terms of the GPL.  Freecom can review the precise
terms of redistribution by reading the GPL licence itself.
