I don't know...it's pretty hard to tell. Just kidding. Every version
of both of those programs (Linux kernel and gcc) are under the GPL, so
they are clearly in violation. If you really want to be technical, they
could just be infringing the Linux trademark if they wrote their own
kernel from scratch... Somehow I find that unlikely.
