  If the software is running under Linux, there is no way one could
say that the GPL v3 should be enforced for services being provided by
a GPL v2 kernel.  This is why I say the motorola using gpl v3 software
under a gpl v2 kernel *is* a moot point.  For instance, GPLv3 software
running under a TiVO, the TiVO can continue to run just as it is now.
They don't HAVE to lock the hardware down for a given peice of
software, they just have to worry about the kernel, which is what
provides the interfaces TO the hardware.
