Google does something similar with the Google Search Applicance.  Out of the 
kindness of their hearts they have decided to honor clause 3 and provide the 
source code.  But if your a customer, good luck figuring out that the GSA 
contains covered code and where to find it.  They don't provide a copy of 
the GPL in writting or on any of the embedded web pages (but it does have an 
"About" page that provides copyright information).  Oddly enough, when they 
consider a model of GSA to no longer be under support, they never get around 
to asking for it back.  But they still seem to promote the idea that 
"leasing" the GSA hardware is a loophole for the GPL and they can pick and 
choose which clauses they will and won't follow.
