What's wrong with that? It seems perfectly reasonable to demand
a namechange when the software is modified. Then people won't
go to them because of bugs in your modifications. 

It would be peculiar if they forbade distribution of their
*unmodified* software unless the name was changed first. 
Is that what you are describing?
