GPL Violation on Linksys WRT350N Source

The Linksys WRT350N source contains a modified gigabit ethernet driver
called BCM57xx which is included as binary only.
this in fact is getting normal for linksys and wouldnt be a problem for
me, but this time this driver is based uppon the
GPL'ed sources of the broadcom tigon3 sources. the unmodified driver
source can be reviewed within the Asus WL500W
GPL Sourcecode including the gpl license statements of this driver. the
driver sourcecodes showing that linksys/cybertan did
some modifications in it to support the connected switch chip to this
ethernet chipset, but releasing these sources now as propertiery
object and overriding the gpl is not valid. if you look into the
bcm57xx.o object you will also find that the module license is still
declared as gpl
